Legal Question in Personal Injury in California

My wife was in an accident where it was the other motorists fault. Our insurance hasd lapsed due to a returned payment while we were on vacation and didn't know about it. The other motorist's insurance said my wife was at fault due to he couldn't prove his client was at fault. He then advised his client to sue us since his client didn't have uninsured coverage. 1- Is that legal for the claims adjuster to tell the to sue us and 2- Is it possible for us to fight for car repairs?

1. Sure. 2. Best bet is to sue in small claims for the property damage, medical bills, and out of pocket expenses (assuming below 7500). Good luck!

Since you are being sued, you need to defend and counter sue. The truth will come out in the end. Without insurance, you'll have to hire your own attorney. At least you should consult a local attorney to get a legal opinion about how you should proceed.
