Hello.

There is no such thing as "average" in wrongful termination recoveries as they range from $0 to millions of dollars. Here are only some of the major factors that determine the size of the recovery:

1. The aggrieved employee's compensation at the time of termination.

2. The gravity of employer's wrongful conduct and the presence of malice.

3. Negative evidence that casts doubt on the employee's credibility.

4. Evidence of poor or less than stellar performance at workplace.

5. Documented emotional distress (therapy, psychological counseling, etc...)

6. The financial condition of the employer and its solvency/ability to pay settlements.

7. The employer's litigation philosophy - does the employer fight till "the last drop of blood," or does the employer prefer to settle claim as early as possible.

And many more factors.

Thanks,

What are the facts? What was your salary? How much did this cost you? How long did it take you to find another job?
