Can a builder credibly act surprised if the house he's selling comes 20% short in square footage during assessment?

If the house is unders construction, there shouldn't be an assessment. Property is only reassessed once construction is complete.
Who cares what his position is? The buyer is entitled to get what he is paying for, so if the building doesn' provide thatt, then he could cancel the contract to buy or renegotiate the price. If he already paid to have it built, he could sue for his damages. That assumes the assessment footage is correct and less than the building was supposed to be.
