Legal Question in Real Estate Law in California

My daughter bought a home in Placerville which apparently has CC&Rs. The original subdivision was built in the 1940's. In 1978 they were due to expire but had an amendment that rolls the CC&Rs over every 5 years. Are they still valid?? She wants to put up a 4 ft fence in the front yard for her dogs and child.

This question would require local research. CC&Rs are of all kinds - some are built into municipal codes, some are private; some "run with the land" and others are contracts between particular parties. All I can say is that it's possible they still apply. I'd look around the neighborhood for other 4' fences and ask the owners if they've had any problems. If there are no other 4' fences, that might be an indication that they are still effectively prohibited.
