Civil Code section 1364 defines the responsibilities of the HOA and the owner(s) or individual units in some detail, and allows certain exceptions to be set forth in the common interest development declaration. In general, however, it may be said that owners are responsible for termites in and on their units, and the HOA is responsible for maintenance of the common areas. I recommend looking up CC 1364 and reviewing it alongside your owners' papers.
