Legal Question in Real Estate Law in California

Deposit requirements for service animals

I am disabled and receiving SSI because of my disability. I have a mental disorder. My Doctor wrote a letter to my landlord so that I could have my service animal. I have chronic depression and anxiety/panic attack disorder. I have a service animal for these reasons. I would like to know if my landlord can require a pet deposit for a service animal.

Re: Deposit requirements for service animals

No, the landlord may not charge a "pet deposit" under these circumstances.

You will be responsible for any damage that occurs because of a dog.

A landlord cannot require an extra pet deposit for "guide dogs," "signal dogs" or "service dogs," as defined by California Civil Code Section 54.1 and 54.2. You do not say if your animal qualifies as such, or even identify your animal as a "dog", whch is what the law specifies.
