Legal Question in Real Estate Law in California

end lease agreement early

we signed a house lease agreement in mid March of this year. My husband's work is slowing down and we are unsure how we are going to keep up with the rent. At this point we want to get out from under this lease agreement with no penalities or hardships. How should we go about handling this?

The only chance you have is to be honest with the landlord and work something out with him/her. The landlord is under no obligation to let you out early and absent reviewing the lease for some defect, I can't tell you that there is a legal means of early lease termination; so just approach your landlord to explain what happened, and ask if he will let you out if you help him (show the house when necessary, be flexible with your move-out date, etc...) get it re-let. Be sure that whatever agreement you get from him/her, it is in writing signed by both sides, and relieves you from any future liabiilty for the lease. Good luck - times are very hard right now, and I've seen a dramatic increase in calls related to harships and/or distressed matters.
