Legal Question in Real Estate Law in California
Freud in Home loan modification
I went to a company to do a home loan modification. They told me that they could modify but needed 2, 000. They said that the one doing my modification woul be a lawyer and I found out recently that is not true; they are not lawyers. They have continue to ask me for more money and if I do not give them to them they say they will stop my modification. They have mistreated me over the phone by screaming to me when I tell them I will not give them more money. I want to know if I can file a law sued against them and also how I can have thier real state license revoked. Please somebody answer me. I have proof of them asking me for money.

First, call the California Department of Real Estate (assuming that they are licensed real estate agents) and file a complaint. Next, contact your local District Attorney's office. Finally, call the State Attorney General's Office. I hear more and more of these stories, and it is sickening how the same people who put you into bad loans are now charging homeowners again to attempt to modify the same junk loan they put you into. I strongly believe that you need to contact their licensing agency - if they claimed an attorney was working with them, then they lied and the DRE can take action against them. You can file a private lawsuit, but it will just cost you more money, and probably not get you anywhere.

Report them to the Dept of Real Estate, the State Bar of California, the Dept of Consumer Affairs, and the police. Your problem with fraud is common. If you're willing to have an attorney try to get your money back, feel free to contact me.
