Legal Question in Real Estate Law in California

Hello,

What are my rights as far as selling a piece of real estate that I own with another person? I would like to sell, he does not. Does this mean I have to wait until the other person is willing to sell?

You can sue in partition to get the court to order that the property be sold. Attorney Whipple, who expertly answers questions on this site, has handled partitions and in the past has estimated the cost at about $14-15,000. It might be cheaper to have the co-owner buy you out.

The trouble with court-ordered partitions is you might have to sell at auction, and you would probably get less than if both of you agreed to list the property for sale.
