Legal Question in Real Estate Law in California

I am a landlord, I have a tenant that has not paid me rent in 3months. What can I do evict him with out getting sued and having him live here anymore time with out paying rent

There is a legal process for evicting a non paying tenant. This procedure must be strictly followed. You should consider retaining an attorney that is experienced in eviction law. The other option is for you to educate yourself in the law regarding evictions.

There are also eviction services in larger cities; use one that is bonded. However, probably one of the first things you should do is learn the basic ground rules for landlording. Obtain one of the paperback self-help law books coverling how to be a landlord or landlord-tenant rights from Nolo Press or similar publisher. Make sure it is based on California law. It will explain when three-day, 30-day or 60-day notices should be used, what they should say, how to write a good lease or rental agreement, when to file an unlawful detainer lawsuit, and so on.

Either hire an eviction attorney, hire an eviction service, read and follow a 'how to evict' book from the bookstore, or ignore the problem.
