Legal Question in Real Estate Law in California
Leaves and Debris from neighbors tree
Live on graduating cul-de-sac. Neighbor above has huge tree that sheds onto our yard. Pool is always full of leaves, we are constantly cleaning driveway and expensive landscaping that we had done a couple years ago. Last weekend we had to pull out all of the ground cover on the slope between the houses and the front yard because the leaves from his tree were so imbedded underneath, the sprinklers clogged up and the plants were dying. It's a daily battle. The gardener spends more time cleaning then gardening. Last weekend I asked him to trim and he turned and walked away from me. Would like advice on the procedure to continue. I know take pictures, but do I send a letter, then if no response, a registered letter. Same thing happened when first moved in 10 yrs ago. After several pleas, I finally offered to split the cost. He said no, but then 8 months later had the tree done and had the $350 bill sent to me. Never even called to say was the timing good and did the offer still stand. I paid it becasue I had made the offer, but needless to say, he's a creep. We don't even have any trees.

Re: Leaves and Debris from neighbors tree
You can sue the neighbor for ''nuisance.'' This may get him to trim the tree regularly.
