Legal Question in Real Estate Law in California

We made an offer on a home (short sale). About three weeks later we found out the home was sold for $20,000 less than our offer. Is this legal? How could this happen? Where can I get information about the sale of this home?

You did not say that your offer was "accepted," and so I have to assume that the Sellers and the Bank elected to accept the lesser offer for a variety of reasons - it may have been made prior to yours, and accepted by the bank, it may have been an all-cash offer, where yours may have been financed. There are a multitude of reasons an offer might not be preferable even through the total dollars offered are less. If your offer was not accepted in writing, then the Sellers have done nothing wrong. You may wish to have the purchase documents reviewed by an attorney to determine what actually happened, and if you have any standing to pursue damages for the sale to another party.

If your written offer was properly 'accepted' in writing by the seller, then you may have a contract breach claim to enforce through specific performance. Without their written acceptance, no contract, no case. Knowing that, if you have a case to pursue, feel free to contact me if serious about doing so.

It would be illegal if the reason was based upon discrimination of some protected class. Contact me directly.
