property line confirmation

based on the city assessor's map, we measured distances to all the markers placed by city surveyors and it seems our neighbor's fence is roughly 25 feet onto our property. Is there any way to officially confirm property lines without getting a new property survey done?

The city building dept should respond to your request to establish the property lines. If not, hire a surveyor. Good luck with the legal problems. Feel free to contact me if you intend to take any action over the encroachment.

Sorry to burst your bubble, but even if you do a property survey, even then your neighbor may claim the property is his by one of several legal principles I have more experience with than any other attorney I know. I have litigated these issues in depth with expert witnesses, county officials, and surveyors in court arguing detailed aspects of possession, tax payments, and other issues. Be careful, because one wrong word or letter communicating to your neighbor may harm what might otherwise be a valid claim you may have to that property. Acting quickly may also be a critical factor.
