renter has flat tire in construction zone of home

Hi,

I'm renting a room out. I told the renter to park on the street because i'm fixing the front lawn into a driveway. The renter tries and parks on the new driveway anyways because she said she did not want to get a ticket parking on the street. She suffers severe tire damage because of a metal spike used to hold the concrete in place during construction of driveway. She wants me to pay for her new tire. Please advise.

If all the facts are as you state, and there are no additional facts that favor the tenant's point of view, I can't imagine a small-claims judge feeling very sympathetic to the tenant. Clearly she was warned and must accept the consequences of going ahead and parking in a construction zone.
