Legal Question in Real Estate Law in California

Responsibility for hidden defect

I purchased a condo and the seller was an investor and did not live on the property. I did not hire an inspector. After closing, I stepped into the shower and found the fiberglass shower base unusually soft in spots and it made a crunching noise. The tenant did not tell the owner about this (presumably), so it was not disclosed. Does the seller have any responsibilty for the repair?

Re: Responsibility for hidden defect

You failed to have the property inspected. You should have, since the problem was easily detected by you, a qualified inspector would not have missed it. If the purchase agreement specifies that you purchased the property ''AS IS'' you're in bad shape and will have to bear the costs of repair.
