Legal Question in Real Estate Law in California

Who is responsible?

I bought a house on July 22, 2008 on July 25,2008 an inspector came, two weeks later I got a notice that the covered patio doesn't have a permit. I bought it like this. I am required to go to court on March 12,2009 for this. Who is responsible. Should my agent be, the broker, or the bank that I bought the house from, for not letting me know about this.

Thank you

Re: Who is responsible?

Read The Friendly Contract. If you bought it As Is, you're responsible. If not, consult an attorney.

Re: Who is responsible?

If you go to court and say the wrong thing, or dont say the right thing, it may complicate matters. There may be ways to hold some others responsible if it is worth pursuing financially. You have had some time since july to take some action, the court will say. Where are you located?

Best,

Re: Who is responsible?

You just bought into a lawsuit. However, it's a small one. All it takes to solve this problem is you getting it permitted now. Go apply. You can pursue the seller, agent[s], title company, home inspection company, etc. for the costs you incur. It this blows up into an expensive problem, feel free to contact me for the legal help you'll need in trying to settle it, or filing suit if it comes to that.
