wachovia sold my home in error while in process of remodifying loan. can I sue and for what?

In error? Unlikely. What I assume you mean is that they foreclosed on it while you were trying to negotiate a remod. There is no rule against them doing so. Unless you can show that they didn't follow the foreclosure rules, or you have a written agreement with them to stop the foreclosure process, you have no basis for a suit.
