Legal Question in Sexual Harassment in California
My brother who is 24yrs old was chatting online with a 15 yr old girl who had never meet in person before but at one point did send her nude pictures of himself. They planted to meet up with each other which never happened. One day I receive a letter stating he has a case based on talking to a minor n there's a warrant out for his arrest and 2 days later detectives were at my house looking for him. It's been one year since my brother last spoken to her and had move out of my house. He is not a sexual predator or intentions of hurting anyone or a criminal just an past event which after a year has come back to haunt him.
Is their a court date to see a judge that has to be issued first before a warrant for someone is issue? What r his chances of no jail time?

It wasn't a "girl, " it was a cop. Obviously neither of you ever watched "Dateline NBC." He is facing serious charges and needs to hire a lawyer immediately. He must not speak to the police. The lawyer he retains will have other good advice for him.
He faces serious felony charges carrying prison time. When threatened, arrested or charged with any crime, �what can you do�? Hire an attorney, unless you know how to effectively represent yourself in court against a professional prosecutor intending to convict. No amount of free 'tips and hints' from here or anywhere else are going to effectively help him in defense, other than the advice [if not already too late] to exercise the 5th Amendment RIGHT to SHUT UP and do NOT talk to police or ANYONE about the details of the case except through an attorney. That includes on this or any other web site or public forum. Most police and prosecutors will happily tell you that 95% of people convict themselves by trying to be 'helpful and cooperative', either during initial contact, questioning, interview or interrogation.
