Legal Question in Sexual Harassment in California
I have reported an instance of sexual harassment in my workplace. The director of human resources insists that I allow my harasser to confront me. Is this legal? What if I don't want to face him?

I am sorry to hear you are going this such an unpleasant experience at your place of employment. The company is required to investigate and take steps to cure the problem. You have the right to tell the HR director that you feel very uncomfortable being confronted by your harasser and you want a legal representative present with you so that you have some degree of comfort and protection. You need to cooperate with the investigation and all the company to take steps to remedy it but you are also entitled to protect yourself.
You are supposed to be protected from a 'hostile' environment, including such confrontation. Such 'insistence' is inappropriate, and you should tell them so. If it would make you uncomfortable, you do not have to allow this. If the company dos not properly handle and remedy the complaint, you may have grounds for legal action. If the harassment has been allowed to go on more than a 'one time instance', after the company learned of it, you may have grounds for legal action.
