Legal Question in Sexual Harassment in California

Retirement Home Resident SH Employee

If a retirement home doesn't have procedures on residents sexually harassing employees, what can be done?

Employee victim doesn't feel employer cares about the dramatic event that occured. They still making employee work there after not feeling comfortable working there and are only giving the resident a ''warning'' and now have 2 people attending his room at once.

Can anything be done? Can victim ask for some paid time off to recooperate? Should victim contact attorney?

Thanks.

It sounds as if you have been deeply affected by the incident and that you may need some time off. You may have a workers compensation claim as well as a civil suit. Contact me directly.

Every employer is obligated to provide a safe and sexual harassment free workplace. So, you have the right to bring action if it isn't reasonably remedied after notice to them. The facts determine whether this is reasonable, considering that your job is dealing with the patients. Feel free to contact me if serious about pursuing this.
