Legal Question in Sexual Harassment in California

Sexual harassment

My wife was a victim of sexual harassment in the workplace. Her male boss exposed himself to her. This happened a few months back. She did nothing about it for fear of losing her job. She just told me about it last night. Is it too late to file a claim against this pig?

It is not too late to file a claim. Because he was your wife's boss, it sounds as though he had a supervisory position at the company. Have there been any other events? She can still report him to HR or whoever it is who's supposed to receive such reports. If it should happen again after the report, and the company doesn't do anything about it, then the company, itself, could be held liable for sexual harassment. On the other hand, depending on the "boss's" position in the company, the company could be liable without such a report. Feel free to contact me directly with more information.

It's not too late, you have a year to bring legal claims on this. Waiting does affect her credibility however. She needs to determine if there are any other people with similar claims, or related complaints about the guy. She needs to present a written complaint to the employer, with demand for remedy, explaining what happened and why she waited. She can also file a claim with the Dept of Fair Employment and Housing or with the EEOC for discrimination. She can also hire an attorney to back up her claim and seek damages if the facts support and justify it. Feel free to contact me if she decides to do so.
