Legal Question in Sexual Harassment in California

sexual harrasement

Would it be sexual harrasement if a female co worker made comments aprox. once a month about my breasts? It is really annoying and disturbing.

Nobody said your life would be free of 'annoyances'. If you reasonably think this is actually 'sexual harassment' and is serious enough to complain about, and the other person wouldn't stop after you requested them to, you could file a request with HR or mgmt to intervene and counsel/discipline the other person.

Some attorneys would say that you have a great case, other would disagree. Since sexual harassment seems to be more of a subjective test, anything can be considered sexual harassment.

With the above said, there remains many questions in your case. Did your co-worker ever touch your breast? Does she rub against you? Sometimes women comment on another woman's breast and it could mean nothing. Is this woman a supervisor? Did you ever complain to a supervisor?

Anyway, you get the picture. Perhaps if you contact my office I can spend a little time on the telephone with you and explore all the facts of your potential case. 818.385.0520.
