Legal Question in Sexual Harassment in California

What can I do when the sexual harrassment is from who the company is contracted

I worked as a food service manager for a company who was contracted with the USMC for 2 years. My job was to supervise civilian cooks, military prisoner cooks and detainees in a military prison.

When I complained to the military officer in charge of the prison that one of the prisoner cooks in the apprenticeship program would not back off and had kissed me, I was removed from my that prison one week later. My company could find no other place to put me so I was laid off and now unemployed. I filed a sexual harrassment claim with my employer but their response was that the military would handle as they see fit and the company is no longer involved. How is this fair to me? I complained about what was going on and now I am unemployed!

There are several levels of problems with your claims--

prisoner is the culprit, not a regular employee;

military is the actual employer, not a civilian company;

various immunities and defenses apply to claims against the government;

bottom line is that your claim would be difficult to prosecute successfully. Contact a local attorney specializing in discrimination to see if anyone is willing to take it.
