Legal Question in Sexual Harassment in California

Sexual Harrassment

Hello I was wondering if and when you are in a work place and your boss partakes in the harrassment... not so much the sexual harrassment but the hostile harrassment then what should you do ? I know that if I tell him he won't do anything for like I said he is a part of the harrassment as well.

I see this message was posted on 11/1. I don't know why it took so long to show up. I apologize. It would be futile, obviously, to complain to the boss. Most companies have an HR person listed in the employee handbook to whom they should complain. Even if there is no handbook, that's the route to go. Someone in the company's management has to be put on notice of the harassment, and then must conduct a reasonable investigation of your complaint. Sexual harassment at work is illegal. If the company fails to remedy, they can be sued. However, you must complain to make the company aware of the problem; go over the head of the supervisor to HR or management. You should talk to experienced counsel about your rights and remedies, and how to handle the situation. Contact me if interested.
