Legal Question in Sexual Harassment in California

Sexual harrassment

I work for a very large medical insurance company. During my first couple months working there i was sexually harrassed by my female co-worker. She would make sexual comments and would touch me without permission. I would ask her to stop, i wanted to tell my manager but i noticed that my manager knew about this problem before i started working there. I did not feel comfortable approaching management because i felt they would not advocate for me. I gave them my two week notice. I don't want this to continue, what can i do?

You may have a claim for constructive termination if a reasonable person in your position would resign. However, you would need very good evidence to support your claim that you did not believe reporting it would have stopped the harrassment. A claim would have to be filed with the DFEH and EEOC.
