My supervisor at work keeps sending me x rated text messages. He sometimes calls and leaves messages, and while we are at work he'll come by my desk and write things like ''can I get some tonight'' or can ''I stick it in you''. I have asked him to stop but he doesn't. I have all the text messages saved on my phone and the verbal messages as well. I am afraid to go to his superior because I know I will get fired, he probably will too, but I really need my job. Everyone at work really likes this supervisor, and I feel everyone will hate me if I tell whats been going on. Somedays he upsets me so bad I don't even go into work. What can I do?

If the company is large enough, you might put your concerns in writing to the person responsible for handling such complaints as specified in the handbook. If none, then to human resources or the company president. You should not have to put up with unlawful harassment.

You must file with the EEOC or the DFEH, obtain a right to sue letter and proceed in civil suit. Please get representation. 20 years experience in plaintiff's employment cases. Contact me directly.

Get over your fears and file a formal written complaint with the HR or mgmt of the company, demanding remedy. You should have your attorney help you with that complaint to make it 'strong', and to advise you how to handle yourself at work. You have described a 'classic' sexual harassment and hostile work environment claim, as long as you can prove your allegations. Those notes are proof, among other things.
