Legal Question in Sexual Harassment in California

off of work

My question is I was sexually harrassed at my workplace and I have been off of work since I reported it on march the 24th while it is to uncomfortable to work on the job with someone who physically put his hands on me but he is still at work should I asked to be compensated for the days I have not been working?

Get an attorney. File a claim immediately with the EEOC or DFEH. You should not be punished but compensated. Call me directly at (619) 222-3504.

I do not have enough facts to determine whether the company is legally obligated to pay for your time off. The company is, however, obligated to remedy sexual harassment. You do not provide enough facts as to the company's actions re the harasser to know whether the company took appropriate further. You can contact me at 805/641-6600, if want to discuss further. If you have followed proper procedures regarding reporting your claim of sexual harrassment and the employer did not follow proper procedures with respect to your claim, you may have a claim. An employer should never punish an employee who has been sexually harrassed by failing to compensate or retaliating against the employee for assertion of their legal rights.

You are obligated to report and complain to the company, to put them on notice of the sexual harassment. If you have, and if they didn't do anything appropriate about it, you can make a claim against them. Contact me to discuss the facts and procedures.

first of all, i would like to offer my regrets for what you have been put thru needlessly at the company you work for. on the legal side of this issue, you certainly should look into retaining an attorney to represent your claims in this area to make sure you are properly compensated and your rights are preserved, especially if you have already reported the incident(s) to your immediate supervisor and/or your HR department. please email me more specific details regarding your case and situation for additional legal assistance and/or prompt representation in this matter.
