Legal Question in Traffic Law in California

Accidental Hit and run

Someone I know was involved in a accidental hit and run. On backing out of a parking lot he brushed against a car parked next to his car.

It was a unattended parked car and my acquaintance wasn't aware if he had scratched the other car, on reaching home the cops was waiting for him.

He admitted his guilt on being asked about it, his excuse was as he had 2 kids in the car he overlooked the fact that he was brushing against the car next to him and thought it was the curb or something else brushing against the tires.

The cops gave him the offended party's number, Both parties have agreed to go through Insurance for the damages, Everyone involved have been notified.

My question is , what legal issues are yet pending for my friend and what steps are further needed... We are in California..

All help appreciated in guiding us..

Thanks and Regards

Re: Accidental Hit and run

There was only property damage, the charge would be a misdemeanor hit and run. There are several court cases that state that this cases should be resolved by a civil compromise. Therefor if the damages are paid then it is unlikely that any charges are paid. Should he be charged with a misdemeanor then he should retain an attorney to represent him.
