Legal Question in Traffic Law in California

appealing after admitting guilt

I was citied for CVC 14601 I showed in court that I had a lic. The PD. talked me into admitting to not useing my turn signal, although i was not citied for and there was no reason that I would use a turn signal during the time I was stoped. I admitted to the not useing my turn signal and was fines $580.00. I am to pay $50 a month. after thinking about this after return to Oregon I began looking up cases in the same county for the same offense and found that the average fine was $144.00. I would like to take this back to court and ask for a reduction in the fine as I feel I have been prejudiced against. I have then a dozen cases showing the$144.00 as aveage, I want to show this to the judge. How would I go about it? would it be an appeal or what? Please advise.

Re: appealing after admitting guilt

When you found that the average fine equaled $144, did that include the penalty assessment. In California a penalty assessment is added to every fine. At this time that is 275%. If the 144 fine did not include the penalty assessment, the total paid would be very close to the amount that you were ordered to pay. It is very difficult to appeal when there is a guilty plea. You might be able to get the plea set aside on the ground that you were coerced into pleading guilty. However, before you take that step you should make sure that the benefits will be worth the time and effort.
