Legal Question in Traffic Law in California

license suspension appeal

I received a letter from dmv suspensing my license for 6 mon. for been a negligen driver due to 3 speeding tickets and another moving violation. Can I repair/reduse the suspension by appeal? ... traffic school, commounity service... anything. All the tickets where given before 6am in a city with a 25mph speed limit on the way to work. there is no public transportation that I can use to get to work that early. Please advice.

Thank you.

Re: license suspension appeal

Yes. Request a hearing in the Driver Safety office of the DMV.

You can only get 4 points within a 12-month period, 6 in 24 and 8 in a 36-month period before they yank your license.

However, a DMV hearing officer has discretion to issue you a restricted or a probationary license to allow you to work, or to allow you to keep you license, assuming you get no other points during probation.

The key is to convince the DMV employee that whatever caused you to get those points-- ie, unusually large number of miles travelled-- is not likely to recur (you've solved the problem). Don't deny you were negligent. Just give a good reason to need to drive, and urge that you have taken measures to avoid a future ticket (ie, you took or will take an extended traffic school course; will car pool for a significant amount of the time; your you will reduce your pleasure driving.)

Good luck. Call me if you need more help. 800-515-0233.
