Legal Question in Traffic Law in California

Parking Ticket from Community College

I recieved a parking ticket from my community college stating that i parked in an undesignated parking space and that ''vehicle moved cones to park.'' I never moved any cones to park. I saw another car pulling out of the stall and i pulled in. There were cones but they were in a stall,in-line diagonal to my car. It's not like they were all thrown around my car or to the side. I thought they meant you couldn't park in the stall they were in. Also, my only class starts at 6:30 pm, the cones could have been moved since the morning. Can the officer make the assumption that it was my car that moved the cones? I didn't do it, so he doesn't actually have any evidence right? I don't know if i should fight the ticket and or pay it and just be more careful where i park at school now?. Do i have good reason to fight the ticket since i didn't move any cones?

Re: Parking Ticket from Community College

At a Trial the parking control officer will testify that your car was parked in the parking space, and the cones blocking the parking space had been moved. You will then have to convince that you did not move the cones. Unless you have a witness your chance of sucess are small.

If you decide to fight the ticket you should look at the Nolo Press book How to Fight Your Traffic Ticket.
