The person at fault in an accident
Who is at fault when someone hits a car that is sticking over the paking line in a parking lot? The driver could not see that the car was over the line. There was nobody in the other car.

When you are driving a car you are responsible to drive it in a manner that it does not collide with other vehicles, or with objects. Thus the driver would be at fault.
