Legal Question in Traffic Law in California
Speeding ticket by aircraft. Legal?
I received a speeding ticket by an airplane. I heard from a traffic school that this is illegal. Should I go to court and hope that both officers or either officer won't show up?

Re: Speeding ticket by aircraft. Legal?
Thank you for your posting, and sorry to hear about your traffic stop.
THere is nothing about a traffic stop involving observations by an officer in an airplane that makes it illegal. It does, however, introduce another level of observational evidence that has to be met to prove the case. Additionally, most cases are dismissed based upon an officer not showing up, and in a case involving a police officer stop and a police officer airplane observation, you must have BOTH officers present.
I'd recommend you fight it, but that is my general philosophy in these types of cases. Best of luck, and if you need a lawyer, or just have questions, give me a call. I'm happy to help.
