Legal Question in Traffic Law in California

what does the above mentioned really say about ashes. I cannot believe that I got a ticket primarily for speeding but with a littering/fire violation tacked on. Before you jump on the anti smoking bandwagon, I am not going to quit and I didn't throw a cigarette butt out of my window and I was still smoking the cigarette when I stopped. The officer stated that it is illegal to flick an ash out of the window and the only justification i can see for that is the ''flaming or glowing substance'' part of that code although in my experience, ash is generally neither.

The last sentence of your question answers it. Generally the ash does not contain any flaming or glowing material.
