Legal Question in Wills and Trusts in California

It's been over 60 days since my trustee received letters requesting copy of trust and an accounting of trust from attorney I hired to write these letters. I have not received a copy of anything requested. I have very little money. Can I request from the courts for a copy of trust and accounting of trust my self.. If so, what forms do I need and/or steps do I need to take to receive these copies.

How long do they have to produce these copies to the court. How long before I have these copies in my hand?

Nothing requires you to hire an attorney to file a petition with the Court to obtain a copy of the trust and an accounting.

The petition, however, must be drafted by hand, and set forth all the facts entitling you to the relief requested. There are no forms. While an experienced trust litigator would have no problems with the process, the layperson in many cases makes mistakes along the way. These mistakes usually delay the process.

If the case is straightforward, you are without doubt entitled to relief, and the trust has funds, you may be able to find a lawyer willing to delay part of his or her fee until you receive a trust distribution. You will have to do some searching, however, and make a compelling case.

Best of luck to you.
