Legal Question in Wills and Trusts in California
deceased receives check
My aunt died in 2003, I had pwr of attorney & executor of her estate. She just received a check for her share of damages in a lawsuit against a pharmacuetical co. for over charging. Do I have a legal right to cash this check?

Re: deceased receives check
If you were/are appointed executor of the estate by the court, then you can cash it as executor. If the estate was under $100,000 in assets and didn't need to be probated, you can get them to re-issue the check to the beneficiaries of her estate using the form in California Probate Code section 13100.
