Disbursement of Annuity Policy Proceeds

My ex husband who recently passed

named me as beneficiary on annuity

policy. His wife at the time of his

death submitted a claim. As

competing claimants to the policy

proceeds, what do I need to do to

make my case to receive the

proceeds without communicating

with the wife to agree on a shared

disbursement. I believe my ex

husband intended for me to receive

these proceeds. Is an interpleader

lawsuit inevitable? What words do I

use in a written or oral statement

that will assist me in being awarded

the proceeds? Thank you.

If you were named as the beneficiary on the policy, then they should pass to you. These are Payable on Death accounts, that is why there is a named benficiary.

If your ex had decided to change it, he was welcome to do so during the course of his lifeime.
