How Can We Find Out if We Are Heir to an Estate?

My neighbor's mother recently passed away in CA. He had anticipated

inclusion in her will; however other family members are being secretive.

He does not know deceased's lawyer. How can he determine if he is an

heir before these secretive family members do away with what is

rightfully his? Thank you very much.

If there is a will, it must be filed with the Superior Court in the county in which the person lived. If there was not will, her estate would need to go through probate. As her son, he has the right to petition the court to administer the probate. He should talk to a probate attorney.

Request a copy of the will or trust. If the family will not cooperate, the daughter can probate her estate on an intestate basis (without a will). That will force the family members to show up with the actual will and object. Find a probate attorney to help with the process.
