Guardianship for disabled adult
Hello,
My son is mentally challenged and has recently been having outbursts of anger which has resulted in hurting himself and others. I telephoned our health care provider who told me that nothing could be done because he is over 18. I need to acquire legal guardianship of my son. Obviously he is not capable of making rational decisions on his own. He stays with his family and we watch over him. What do I need to do to obtain guardianship and can two people be awarded this (ie-mother and sister).

I'm not sure if you'll need a conservatorship or guardianship. There is the Office of Public Guardian in every county. Call them and seek some of their expertise. It's an appointed office and usually the Public Administrator (an elected office) is appointed to that job if he/she wins the election. (I once ran for the office in Orange County. That's how I know they are there.) If the form for a guardianship or conservatorship (It's a Probate Form available on the internet.) permits you to seek a primary and an alternate then you can. In California, the procedure is called a Conservatorship and you can definately do this. Also, if your son needs to get medical help and qualifies for Medi-Cal, etc, we can help you obtain those benefits for him.
