Legal Question in Wills and Trusts in California
Do heirs have a right to claim desceased parent trust shares?
Both of my parents are listed beneficiaries in my Grandmothers
Trust. However my Father and two of his sibblings also beneficiaries are now deceased. My Mother has recieved zero of
Grandmothers Trust. The only communication between my Mother and
the Executor my Aunt is when the property taxes are due. The
considration to sell seems to fail. My Aunt is upgradeing the
properties and ask my mother for a copy of my fathers death certificate. However she never showed up to pickup the document
which I found strange. My Mother has no understanding of the
complexities of Trust & Real Estate Law. And has no desire to
learn unfortunatley. My Father wqs my Grandmother favorite son
who had always been loyale and dependable before and after her
death. The last we have heard is that the wives of the desceased
beneficiaries get nothing if they should sell and that they have
decided to keep the property in the family(That is their immediate family). My Mother is takeing no action on this issue
I am an legal heir what rights if any do I have to claim my Fathers Trust Share?

Re: Do heirs have a right to claim desceased parent trust shares?
Your father's shares would go to your mother if he did not have a will unless the trust has another scheme for succession.
