My mom passed away last night, and I need some help please
Hello, My mom passed away last night after a short battle with Cancer. I am in PA, and my mom in Ca. My mom only had a will that was over 10 yrs old from when she was married to my step-dad. He put her through a nasty divorce, but she had not made a new will. In this will my step-dad gets everything she had. In the divorce she got the house filled with antiques. Will he get everything, or is there a leg for me and the other sibblings to stand on? Should I retain an attorney? What should I do now?

I replied to your second question. Actually, the will is not voided, only the portion that leaves anything to the ex.

A divorce automatically voids the will that gave the estate to your former step-father. You definately have standing to probate her estate. If you need help, please contact me by email, at [email protected] .
