Legal Question in Wills and Trusts in California

questionable change of will

Aunt who lived in CA, died 1-1-04. we live in PA. We had original will in 1979 showing my dad/mom sole beneficiaries. spouse of aunt, my uncle died in 1983 and will requested back for update. Did not received new copy. Aunt hired aid who helped her in last few years and after death, was told by aid that aunt changed will in 2001 and father not beneficiary. We have now received notice from aid's attorney that estate is in probate and we now see that there was a copy of a fill in will that my aunt did sign but did not complete herself. There are 2 witnesses signatures. We strongly feel that my aunt was not aware of what she was signing or where she was signing because she had degenetive eye disease and could not see that well.

We would like to hire CA lawyer in Placer County that specializes in this area. We are very short on time.

I spoke to an attorney who serves Placer County and told them about your facts (elder abuse and undue influece) and he may be interested. Please email me with your information so I can give you Mr. Keeler's phone and address. Thank you.

Re: questionable change of will

Do talk with a lawyer--depending on the facts involved, the will may not be valid or the law may presume undue influence by your aunt's aide. It's certainly worth checking as soon as you can, and the will contest may be easier to do now than after probate is opened.
