Legal Question in Wills and Trusts in California
Requirements of executor or adminstrator of an estate
I am a resident of Alabama who will be responsible for handlilng my aunt's estate in California. In Alabama, last will and T. can obsolve one of need for bond. Does same hold true in California. What is required to be bonded . . . collateral, etc.

The will can waive the bond requirement, although the final decision is up the the probate court--some always want a bond, others do not.

There may not be a need for a bond. However, you would do well by obtaining representation so that you would not have to travel to CA. Call me directly at (619) 222-3504.

A will can waive bond but most Courts in California will require you to post bond. If you need help in the Sacramento (Northern California/Central Valley) area please contact me. Good luck. -JBP

Although a will can waive the requirement of the bond, the courts here require bond if the executor is out of state.
