Legal Question in Wills and Trusts in California

SRDP dies without will and out of state property

My brother passed away in CA without a will. I am his closest living relative (parents dead, no children, no other siblings). He and his partner lived together in CA for 5 years but only registered their partnership 8 months prior to his death. My brother had substantial credit card debts accrued over the last 5 years. His only real property was a house in Colorado (rental property) and some partnership investments left to him by another family member 8 years ago. As Colorado does not recognize domestic partnerships, to whom would his assets go and who would be responsible for his debts?

California law applies and the Domestic Partner laws are still in flux. Has his partner applied for probate? Call me directly at 16192223504.
