Legal Question in Wills and Trusts in California

will search

Hello. I'm not quite sure how to do this but i need to obtain a copy of aunts will, she passed away in santa maria,calif. November 24th 2003..if i call the courthouse will i be able to obtain this document, or is there someone out there who charges a small fee to do this for me? Thank You.

Look for an attorney service to conduct the search. If you can't find one up there, look near your home because they may have a contact up there.

You will only find the will at the court if someone filed it. You might want to ask the interested parties if someone has a copy of it.

You can obtain it from thew clerk of the court, but only if you are named in the will. This assumes your aunt's estate was probated, or the will was filed. If you have an address for your aunt at the time of death, it may be easier to find.

If the will was submitted to Probate, because of net value over $100,000.00 or ownership of non-joint tenancy property, then the Court will have the records.

I agree with Atty. Sirkin, call the Clerk of the Court.
