Legal Question in Workers Comp in California
My husband had emergency surgery two years ago for a blocked intestine and his company put him on family leave until he was cleared by his doctor to return to work. This past October 2013 while carrying 60 lbs boxes down stairs (client has no elevator)he suffered a hernia . He had no days off available and was told he would likely lose his job if he took the time off. So we scheduled his surgery for Dec. 23, 2013. He was cut from the top of him stomach to his belly button about 9 inches. They used pig skin to hold in his intestines and stapled him up. We were told by his employer that we had to go thru Cigna (medical ) and fill out paperwork for family leave to protect his job and for us to be paid. We have not been paid yet and we are hurting. Also can we sue them for forcing him to do that job knowing the client had no elevator and they had 18 boxes he would have to carry at 60lb each causing his hernia. Or can you tell me what our options do we have available to us.
