Legal Question in Workers Comp in California

My injury is cured and my doc wants me to return to work

For 7 months, I have been on TTD for an injury to my elbow. I have only had 6 physical therapy sessions in 7 months and the doctor wants me to return to light duty--name removed--My condition is ''tennis elbow'', which is diffficult to cure he tells me--name removed--I can't do my job with this injury as it was caused from RSI and I will be doing that upon my return--name removed--What can I do--name removed--Should I hire an attorney--name removed--What are my rights--name removed--He says medically there is nothing more he can do...so am I just supposed to live with the injury and accept not being able to use my arm for household duties, tennis, lifting, throwing a ball--name removed--What should I do?

I always suggest a attorney because comp is so unique that most people are at a disadvantage when representing themselves. My recommendation is to request a change in treating physicians. If the new doctor does not work out, then get an attorney.

Yes, live with it. Under the new law, subjective complaints provide no impairment rating. However, they also suggest not everything has been repaired or reviewed with respect to your injury. Thus a new primary treating physician.
