Legal Question in Workers Comp in California

I am an over the road truck driver, I fell and hurt my back on the job and the doctor put me on non driving light duty. the company is 180 miles from my home in another city, theyre telling me i must show up there every day for eight hours of work if I want any benifits otherwise they will consider me refusing the light duty offered to me. doesnt that seem extreeme to make me either drive that far twice a day or pay for a place myself to stay to get benifits

It is unreasonable. They need to pay you temporary disability benefits. You need to ask the doctor to take you off work or if the doctor refuses change to a doctor who will take you off work. If they refuse benefits you need to file for a hearing. Feel free to call us at 213.388.7070 for a free consultation.

If the doctor says non driving light duty, then I suppose that you must ask the insurance carrier or employer to provide transportion to and from your workplace, otherwise you are entitled to total temporary disability.
