Legal Question in Workers Comp in California

Settlement & Voc Rehab

I had voc rehab with payment of about $12000. I just received a letter from the insurance co about a settlement and they want to subtract the amount paid for the voc rehab from the settlement. I thought the voc rehab was a separate benefit. Can they subtract it from the settlement? DOI was 1-9-03.

If the $12,000 was for permanent disability advances, then the insurance co is entitled to take credit for the advances to permanent partial disability at time of settlement or award after trial. If you want an accurate evaluation, plese call to make an appointment for a free consultation.
