i am currently under workers comp and the insurance company is denying me all treatment my primary Dr. has subitted. All of the treatment is very routine. I was first injuryed on Sept. 16 2008 and my employeer didn't do anything but give me a back brace and tell me to get back to work. Later in the month of Sept. I was injuryed even worse. I was wondering being that I was injuryed on the 16 of sept. and the employeer didn't do anything for my treatmeant am I eligable for all treatments because of there neglagince?

You need to retain an attorney who can refer you to a treating doctor and if the treating doctor determines that it would be necessary that you be taken off work for a short period of time before you re-injured yourself, certify you for your temporary disability benefits. Negligence usually does not apply to workers' compensation.
Instead, the fact that your doctor didn't send you for medical care, after you gave notice to your employer of injury, it means that you can choose your own primary treating physician. Unfortunately, without an attorney, it is almost impossible for the injured worker to navigate through the work comp. system looking for the right PTP.
